These General Terms and Conditions of Sale (GTCS) apply to all sales made by Maison Bayu, a brand operated by the company BNC IMPORT, via its website, its sales representatives, or any other sales channel.
Any order placed implies full and unreserved acceptance of these Terms and Conditions.

2. Scope of Application
These Terms and Conditions apply to:
- retail customers (B2C) purchasing for personal use;
- professional customers (B2B): resellers, businesses, communities.
Any specific condition granted to a professional customer must be subject to a separate written agreement.
In accordance with Law No. 2000-83 of August 9, 2000 relating to electronic commerce and exchanges, and Law No. 92-117 of December 7, 1992 relating to consumer protection, the customer acknowledges having read these Terms and Conditions before placing an order.
3. Products
Maison Bayu products notably include scented candles, diffusers, mists, wax melts, massage candles, and fragrance products.
Visuals and descriptions are provided for informational purposes and are non-contractual.
Slight variations (color, texture, olfactory rendering) may exist due to the handcrafted nature of the product, without affecting product compliance or constituting a defect.
4. Prices
4.1 Individual Customers (B2C)
Prices are indicated in Tunisian Dinar (TND), inclusive of all taxes (TTC), including Tunisian VAT at the applicable legal rate, excluding delivery fees.
Delivery fees are indicated separately before order validation.
4.2 Professional Customers (B2B)
Prices are indicated exclusive of tax (HT) and are subject to:
- specific pricing grids;
- tiered or volume-based pricing policies.
VAT at the legal rate in force in Tunisia is applied to the invoice, in accordance with the Value Added Tax Code.
The final applicable price is the one appearing on the invoice issued by BNC IMPORT (Maison Bayu).
4.3 Price Modification
Maison Bayu reserves the right to modify its prices at any time. However, the price applicable to any order is the one in force on the day the order is placed.
5. Orders
5.1 B2C Customers
The order is validated after payment confirmation. It becomes firm and final upon validation, subject to the customer exercising their right of withdrawal as provided in Article 9.1 herein.
5.2 B2B Customers
Orders are placed via purchase order, sales representative, or order book.
Any validated order is firm, irrevocable, and non-cancelable, unless prior written agreement is granted by Maison Bayu.
Maison Bayu reserves the right to refuse an order in the event of a prior dispute, payment default, or damage to the brand image.
6. Payment
6.1 B2C
Mandatory cash or immediate payment (online or cash on delivery depending on the options offered on the site).
Accepted payment methods are indicated at the time of order placement.
6.2 B2B
Payment according to negotiated conditions:
- cash / immediate payment;
- bank transfer;
- contractually validated schedule.
In the event of late payment, penalties may be applied in accordance with current Tunisian legislation. Maison Bayu reserves the right to suspend current or future deliveries until full payment of the amounts due.
7. Delivery
Delivery times are provided as an indication only. Any delay shall not give rise to compensation, except in cases of manifestly excessive delay exclusively attributable to Maison Bayu.
The customer is required to check the goods upon receipt in the presence of the carrier whenever possible.
7.1 B2C
Any apparent anomaly (damaged package, missing product, reference error) must be reported within 72 hours of receipt by email to contact@maisonbayu.com, accompanied by supporting photos.
Hidden defects may be invoked under the conditions of Articles 658 et seq. of the Code of Obligations and Contracts.
7.2 B2B
Any claim relating to an apparent defect must be reported on the very day of delivery on the delivery slip and confirmed in writing (email or registered mail) within 48 hours.
8. Sensitive Products & Climatic Conditions
Products containing vegetable or mineral wax, or concentrated fragrances, can be sensitive to high temperatures.
Softening, slight aesthetic deformation, or condensation linked to transport or weather conditions does not constitute a defect or a ground for return, provided the product remains usable according to its intended purpose.
Maison Bayu declines all responsibility in the event of:
- poor preservation after delivery;
- inappropriate storage (prolonged exposure to heat, humidity, or UV rays);
- use not compliant with the instructions appearing on the product or its packaging.
9. Right of Withdrawal & Returns
9.1 Individual Customers (B2C)
In accordance with Article 30 of Law No. 2000-83 of August 9, 2000 relating to electronic commerce and exchanges, the individual customer has a period of 10 working days from receipt of the product to exercise their right of withdrawal, without having to justify reasons or pay penalties.
To exercise this right, the customer must notify their decision by email to contact@maisonbayu.com before the expiry of the period.
Returned products must be:
- brand new;
- unopened;
- unused;
- in their intact original packaging, with any potential accessories.
Return shipping costs are the responsibility of the customer, except in case of an error or defect attributable to Maison Bayu.
Products excluded from the right of withdrawal: opened, used, or tested products; unsealed fragrance products; lit candles; personalized or custom-made products; promotional or limited edition products; products whose nature does not allow for returns due to hygiene or health protection reasons.
9.2 Professional Customers (B2B)
In accordance with applicable law, no right of withdrawal applies to professional customers.
Returns are accepted only in the event of:
- preparation error attributable to Maison Bayu;
- manufacturing defect recognized after expert evaluation.
No returns will be accepted for:
- unsold items;
- overstock;
- insufficient stock rotation;
- commercial change of mind;
- post-delivery deterioration.
10. Refunds
When a return is accepted:
- the refund takes place within a maximum period of 10 days from receipt and inspection of the returned product, in accordance with Article 30 of Law No. 2000-83;
- it covers the price of the product;
- initial delivery fees are only refunded if the entirety of the order is returned and the return is attributable to Maison Bayu;
- the refund is made using the same payment method used during the order, or by bank transfer / credit note for B2B customers.
11. Legal Warranties
Regardless of any commercial warranty, Maison Bayu remains bound by:
- the legal warranty of conformity provided by Law No. 92-117 of December 7, 1992 relating to consumer protection;
- the warranty against hidden defects provided for in Articles 658 et seq. of the Code of Obligations and Contracts.
Under these warranties, the customer can, depending on the case, obtain product replacement, repair, or a refund, in accordance with applicable legal provisions.
12. Liability
The liability of Maison Bayu cannot be engaged:
- in the event of improper use of products not conforming to instructions for use;
- in the event of allergic reactions or individual sensitivities, the customer being invited to consult the list of ingredients before use;
- in the event of professional use not conforming to the product's intended destination;
- in the event of force majeure within the meaning of the Code of Obligations and Contracts.
These limitations do not apply in cases of gross negligence or breach of public policy legal obligations.
13. Intellectual Property
All elements of the Maison Bayu brand (texts, images, packaging, formulas, fragrances, concepts, trademarks, logos, trade names) are protected by Law No. 94-36 of February 24, 1994 relating to literary and artistic property and Law No. 2001-36 of April 17, 2001 relating to the protection of trade, commercial, and service marks.
Any reproduction, representation, modification, or exploitation, total or partial, without prior written authorization from BNC IMPORT, is strictly prohibited and constitutes an act of infringement liable to prosecution.
14. Protection of Personal Data
In accordance with Organic Law No. 2004-63 of July 27, 2004 on the protection of personal data, as amended, Maison Bayu (BNC IMPORT) collects and processes the personal data of its customers in compliance with current legal provisions.
Data Controller: BNC IMPORT (Maison Bayu) – Floor 3, Solaris Building, Rue du Lac Anasy, Les Berges du Lac, 1053 La Marsa, Tunis.
Purposes: management of orders, delivery, invoicing, after-sales service, customer relationship management, commercial prospecting (with prior consent), compliance with legal and fiscal obligations.
Data Collected: last name, first name, postal address, email address, phone number, payment data (processed by approved banking providers), order history.
Recipients: authorized personnel of Maison Bayu, service providers (hosting, payment, logistics, carriers) bound by a confidentiality obligation, administrative or judicial authorities when required by law.
Retention Period: data is kept for the period strictly necessary for the purpose of processing, and up to the legal deadlines (notably 10 years for accounting documents).
Customer Rights: the customer has a right of access, rectification, opposition, and deletion of their data. These rights can be exercised by sending a request to contact@maisonbayu.com, accompanied by a proof of identity.
In case of disagreement regarding the processing of data, the customer may contact the National Instance for the Protection of Personal Data (INPDP) in accordance with current legislation.
15. Dispute Resolution – Mediation
In the event of a dispute, the customer is invited to contact the Maison Bayu customer service first at contact@maisonbayu.com in order to seek an amicable solution.
Failing an amicable resolution, the retail consumer may resort to mediation mechanisms provided by Tunisian legislation, notably with the Consumer Defense Organization (ODC) or any other competent mediator.
16. Applicable Law & Jurisdiction
These General Terms and Conditions of Sale are governed by Tunisian law.
Failing an amicable resolution, any dispute relating to their formation, execution, interpretation, or termination will be submitted to the exclusive jurisdiction of the competent Tunisian courts, in accordance with common law rules.
Final Clause
Any order placed with Maison Bayu (BNC IMPORT) constitutes full and complete acceptance of these General Terms and Conditions of Sale.
If any clause of these Terms and Conditions should be declared null or unenforceable, the other clauses shall retain their full validity and continue to take effect.
